In response to your January 22, 1993 letter requesting additional information, assurances, and significant facility upgrades in order to complete our Plan Of Operations, American Exploration Company regrets to respond that we cannot comply with all items listed for the following reasons: American Exploration Company did not take assignment of all Oryx operations as previously assumed, as described in our April 12, 1993 letter to the National Park. We do not interpret facility abandonment as a routine activity and would not consider facility evaluations for space optimization as practical operations. If extraordinary protection is being required for saltwater spill potential, then what future extraordinary requirements are going to be raised for other potential adverse impacts: noise, dust, thermal, visual or other concerns? Other items of disagreement include the detail required to describe the facilities, operations, and park resources; the requirement for Best Available Technology in place of industry standards, implying the significant facility upgrades could be imposed.
