Please review this P-13 permit application received from BNP Petroleum yesterday, January 4, 2006. You reviewed a similar permit application from BNP on May 10, 2004. BNP did not pursue the permit application any further at that point. The park asked BNP to make the following corrections using your comments for the May 2004 permit application: We would like to insert the following sentence in place of the section currently marked through on FORM P-13: The plan of operations approved by the National Park Service for the Dunn-McCampbell A8 well obligates the operator to plug and abandon the fresh-water well as part of its reclamation/remediation responsibilities for the site under 26 C.F.R. Part 9, Subpart B. However, the revised application we received now cites Texas Natural Resources Code §89.011, which refers to private landowners requesting the use of an abandoned well as a freshwater well, which is, in our opinion, inapplicable to this situation since we are not a private landowner and do not intend to use any wells for any means.
