The action considered in this draft environmental impact statement (DEIS) concerns the Makah Indian Tribe's February 2005 request to resume limited hunting of eastern North Pacific (ENP) gray whales (Eschrichtius robustus) in the coastal portion of the Tribe's usual and accustomed fishing grounds (U&A), off the coast of Washington State, for ceremonial and subsistence purposes. The Tribe's proposed action stems from the 1855 Treaty of Neah Bay, which expressly secures the Makah Tribe's right to hunt whales. To exercise that right, the Makah Tribe is seekiing authorization from the National Oceanic and Atmospheric Administration's National Marine Fisheries Service (NMFS) under the Marine Mammal Protection Act and the Whaling Convention Act.
