This series is intended for Determination of Eligibility documents for National Park Service (NPS) historic properties. Documents may be either Section 106 (National Historic Preservation Act) Consensus Determination of Eligibility (CDOE) or National Register of Historic Places (NRHP) Determination of Eligibility (DOE) and any supporting documentation. CDOE: A Consensus Determination of Eligibility is part of the section 106 process. For historic properties managed by Federal Agencies or Departments, the federal entity uses the CDOE process found in the Advisory Council on Historic Preservation (ACHP) regulation 36 CFR § 800.4. This process is used to determine an historic property's eligibility for the NRHP for Section 106 purposes only [36 CFR § 800.4 c (1) (2)]. The CDOE process allows federal decision makers, in consultation with either State Historic Preservation Officers (SHPO), Federal Historic Preservation Officers (FPO), or Tribal Historic Preservation Officers (THPO), as well as other consulting parties to assess an historic property using the NRHP Criteria for Evaluation [36 CFR § 60.4] and if they agree that any of the criteria are met, the historic property is considered eligible for the NRHP for Section 106 purposes [36 CFR § 800.4 c (2)]. DOE: A Determination of Eligibility is a decision by the Keeper of the NRHP that a district, site, building, structure or object meets the NRHP Criteria for Evaluation [36 CFR § 60.4] although the property is not formally listed in the NRHP.
